Application process overview
The CR1/IR1 visa process typically takes 16-24 months and consists of the four stages below. Baan Thai offers an end-to-end solution that guides you through each of these steps, from filing the initial application with the USCIS to preparing your spouse for a successful interview at the US Embassy in Bangkok.
- Apply to US Citizenship and Immigration Services (USCIS)The first step is to submit your application to the USCIS, a branch of the Department of Homeland Security, where you and your spouse’s backgrounds are checked for visa eligibility. This step includes reviewing the legitimacy of your relationship.
- Your application is reviewed by the National Visa Center (NVC)Once your application is approved by USCIS, it is sent onto the State Department’s NVC where your relationship, spouse’s background, and financial ability to support your Thai partner is further assessed and additional information is submitted by you.
- Interview at the US Embassy in BangkokAfter your petition is approved by the NVC, your application is forwarded to the US Embassy in Bangkok, Thailand. Your spouse will submit medical and criminal background clearances and will schedule the all important and final step: an in-person interview with a US Embassy Officer.
- Obtain the CR1/IR1 visaYour spouse receives their visa two to seven business days after successfully passing the interview and is then free to travel with you to America.

Baan Thai Is:
A US-quality law firm, practicing in your spouse’s home country
Baan Thai practices with the same quality and benefits of a US law firm. The organization was founded by Mark Friedman, who practiced in the US for more than 35 years, leading global legal departments. Mark brings those same American-standards, processes, practices, and technology solutions to you. The firm licenses the same cloud-based client portal – Docketwise – used by 80% of US based immigration firms so you can safely provide your information and documents, and have that information automatically populate your USCIS and NVC applications, saving you time. We are your US law firm in Bangkok.
Specialized in US spouse visas
While there are many legal firms in Bangkok, there are few that predominantly focus on immigration. We stay abreast of developments and best practices in US immigration law as active members of the American Immigration Lawyers Association. And our training, technology, and systems are all designed to make the immigration process as efficient as possible. You’ll find few, if any, other firms in Bangkok who provide this same specialized support. We’ve literally helped hundreds of couples immigrate abroad, and we’re ready to help you.
Experienced in challenging matters
We understand not every US spouse visa case will be easy. If your matter presents challenges, we can help present your case in the best possible light. When couples have believed their case was hopeless, we’ve successfully advocated and secured their US spouse visa. We understand what factors US Immigration Officers are assessing and how best to present your information with clarity.

Being Bangkok-based means we take special care of your Thai spouse
The US immigration process can be intimidating for Thai nationals who have never dealt with US government officers. Your spouse will eventually interview one-on-one with a US immigration officer – who will ask probing questions about your relationship and their character. We will help your spouse prepare for this last critical step in the process in their native language. Going into the interview fully informed and prepared best assures a successful outcome.
Your Thai spouse will be working with Noina and her team, who has helped hundreds of couples through the interview process. Simply put, your spouse will be well taken care of as she or he collects required information from Thai authorities and prepares for the US Embassy interview. An added benefit is that our offices are located a short 5-minute walk to the US Embassy, and we’ll ensure that your spouse gets to the right place on time.

คําถามที่พบบ่อย
Yes, your spouse will need to interview at the US embassy, obtain a medical certificate and potentially a police certificate, and provide translated copies of documents – such as your marriage certificate.
No, the interview will be conducted in their native language by a Thai-speaking American staff member. However, while your spouse isn’t expected to speak English fluently, some English will be required. In case of a misunderstanding, the interviewer may get assistance from a native Thai speaker on staff at the Embassy.
Your income must be equal to or greater than 125% of the US poverty line. For most petitioners, that equates to a minimum yearly income of $22,887. See the full federal guidelines here. If you don’t meet this qualification, your spouse can still get the visa if you have sufficient assets outside of your income. Another option is to get a co-sponsor (usually a close family member) who is willing to undertake the legal responsibility to support you and your spouse.
Whether or not your application is approved depends on two things: your ability to financially support your spouse in America and establishing the legitimacy of your relationship. In other words, your chance of approval depends on the background of you and your spouse. Some of the major issues that can affect your case are your income level, how you met each other, how many times you’ve filed a petition for the visa, and whether either of you have a criminal record.
Be truthful and honest about your case and answer all questions concisely without giving excessive information.
